Welcome to Throwbackcases. These Terms of Service (“Terms”) govern your use of our website and your purchase of products from our online store.

1. About Throwbackcases

Throwbackcases is an online phone case brand creating art-driven, nostalgic and customizable phone cases for select Apple iPhone, Samsung Galaxy and Google Pixel devices.

2. Online Store Terms

By using our site or placing an order, you represent that you are legally able to enter into a purchase transaction in your jurisdiction or that you have permission from a parent or legal guardian where required.

You may not use our products, website or services for any unlawful, abusive, fraudulent or unauthorized purpose.

3. Products and Product Descriptions

We make reasonable efforts to display product images, colors and descriptions accurately. However, colors may appear differently depending on your screen settings, device display, lighting or printing surface.

Our cases are made for the specific phone model selected by the customer. Product fit, camera openings and dimensions vary by device model. Customers are responsible for selecting the correct phone model before checkout.

We reserve the right to modify, update or discontinue products, designs, collections, pricing or availability at any time.

4. Made-to-Order Products

Throwbackcases products are produced after an order is placed. We use third-party production and fulfillment partners to create and ship made-to-order products.

Because products are made to order, cancellations, changes, returns and exchanges may be limited once production begins. Please review our Return & Refund Policy before purchasing.

5. Orders and Acceptance

Submitting an order does not guarantee acceptance. We reserve the right to refuse, cancel or limit an order for reasons including:

Product or variant unavailability
Suspected fraud or unauthorized payment
Pricing or listing errors
Prohibited custom content
Violation of these Terms
Inability to fulfill the requested order

If we cancel an order after payment has been processed, we will issue an appropriate refund for the canceled item or order.

6. Prices and Payment

Prices are shown in U.S. dollars unless otherwise stated.

Applicable taxes may be calculated and charged at checkout based on your location and the requirements of applicable law.

You agree to provide current, complete and accurate payment and order information. By submitting payment information, you represent that you are authorized to use the payment method provided.

7. Shipping and Delivery

Shipping timelines are estimates and may vary based on production time, carrier conditions, holidays, product availability, weather, address accuracy and circumstances outside our reasonable control.

8. Returns, Refunds and Production Issues

Our products are made to order. Returns and exchanges are not accepted for change of mind, incorrect phone model selection or customer ordering mistakes once production has begun.

If a product arrives damaged, defective, incorrect or materially different from what was ordered, contact hello@throwbackcases.com within 30 days of delivery with your order number and clear photos of the issue.

9. Custom Products and Customer-Submitted Content

For custom or personalized products, you may be permitted to upload photographs, artwork, names, phrases, graphics or other content.

By uploading or submitting content, you represent and warrant that:

You own the content or have permission to use it for the product requested
The content does not infringe another person’s copyright, trademark, privacy, publicity or other legal rights
The content is not unlawful, threatening, hateful, sexually exploitative, abusive or otherwise prohibited by law
The content does not include confidential information you do not have permission to share

You retain ownership of your original submitted content. You grant Throwbackcases and its necessary production and fulfillment partners a limited permission to use, reproduce and process the content only as needed to review, produce, fulfill and support your custom order.

We reserve the right to refuse or cancel custom orders containing content that we believe may violate these Terms, infringe third-party rights or create legal or safety concerns.

10. Throwbackcases Artwork and Intellectual Property

Unless otherwise stated, content on our website, including brand names, logos, product photography, original artwork, product descriptions, graphics, website text and collection concepts, is owned by or licensed to Throwbackcases and may not be copied, reproduced, sold or used commercially without permission.

Purchasing a phone case does not grant the purchaser ownership of or commercial rights to the printed design.

11. Parody and Inspired Designs

Certain designs may be created as parody, commentary or inspired artwork. Unless expressly stated otherwise, Throwbackcases is not affiliated with, endorsed by, sponsored by or connected to any designer brand, entertainment company, artist, record label, movie studio or other third-party rights holder referenced by or associated with an inspired design.

12. Reviews, Photos and Customer Feedback

If you submit a review, testimonial or product photo for publication, you grant Throwbackcases permission to display that submitted review or image on our website, social channels or marketing materials, unless you request removal where applicable.

We will not use a private custom photo submitted solely for production as marketing content without permission.

13. Prohibited Uses

You may not use our website or services to:

Violate applicable laws or regulations
Infringe intellectual property or privacy rights
Submit fraudulent, misleading or harmful information
Upload malware or malicious code
Harass, threaten or abuse others
Attempt to interfere with the operation or security of the website
Copy or exploit website content or product designs for unauthorized commercial purposes

14. Disclaimer of Warranties

We make reasonable efforts to provide accurate product descriptions and quality products. Except as required by applicable law, products and services are provided on an “as available” basis without warranties beyond those expressly stated in our policies.

Phone cases are intended to provide everyday protection, but no phone case can guarantee that a device will never be damaged. Throwbackcases is not responsible for damage to a phone, screen, camera or other device resulting from drops, impacts, misuse, accidents or use of a case.

15. Limitation of Liability

To the fullest extent permitted by applicable law, Throwbackcases will not be liable for indirect, incidental, special or consequential damages arising from the use of our website or products.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable consumer protection law.

16. Governing Law

These Terms are governed by the laws of the State of Washington and applicable United States law, without regard to conflict-of-law rules, except where the consumer protection laws of your jurisdiction require otherwise.
